These Terms & Conditions (“Terms”) apply to purchases and services provided by Onside Technology Solutions Ltd (“Onside,” “we,” “us,” or “our”) through www.onsidetechsolutions.co.ke, our physical store, and other authorized sales channels.
By placing an order or using our services, you agree to these Terms, subject to your rights under applicable Kenyan law.
1. Products, Pricing & Availability
We make reasonable efforts to ensure that product descriptions, specifications, images, prices and availability are accurate.
Prices are exclusive of VAT unless otherwise stated and may change due to supplier pricing, exchange rates, market conditions or other commercial factors.
Products are subject to availability. Where a material pricing, specification or stock error affects an order, we will contact you before proceeding and provide an appropriate solution.
Product images are for illustration and may vary slightly due to manufacturer updates or packaging changes.
2. Orders & Payments
Orders are subject to confirmation of stock, specifications, pricing and payment.
We may decline or cancel an order where a product is unavailable, payment cannot be verified, information provided is inaccurate, an obvious pricing error has occurred, or fraudulent activity is reasonably suspected.
Where we cannot fulfil a paid order, an appropriate refund or alternative arrangement will be offered in accordance with applicable law.
Corporate quotations and LPOs are subject to their stated validity period, stock availability and agreed payment or credit terms.
3. Delivery
We aim to deliver within the timeframe communicated when your order is confirmed. Delivery times are estimates and may be affected by courier delays, supplier delays or circumstances beyond our reasonable control.
Customers are responsible for providing accurate delivery information and should inspect their orders upon receipt.
Please notify us as soon as reasonably possible if your order arrives damaged, incomplete or incorrect.
4. Returns, Refunds & Exchanges
Returns, refunds and exchanges are handled according to our Return & Refund Policy and applicable Kenyan consumer law.
Products may be inspected or tested before a return, repair, replacement, exchange or refund is approved.
Change-of-mind returns may be restricted for opened, activated, customized or specially ordered products, where permitted by law.
Nothing in these Terms or our Return & Refund Policy limits any consumer right or remedy that cannot lawfully be excluded.
5. Warranty
Warranty coverage varies by product and manufacturer. Customers should confirm the applicable warranty before purchasing.
Valid warranty claims may be subject to inspection by Onside, the manufacturer, distributor or an authorized service centre.
Depending on the circumstances and applicable warranty, the appropriate remedy may include repair, replacement or another remedy available under Kenyan law.
Warranty may not cover accidental damage, liquid damage, misuse, unauthorized repairs or other exclusions specified by the manufacturer.
Where we assist with sending a product to an authorized service centre, processing timelines will depend on the manufacturer, diagnosis and availability of parts.
Nothing in these Terms excludes statutory rights that cannot legally be excluded.
6. Repairs & Technical Services
Devices submitted for repair may require inspection or diagnosis before the final repair cost and timeframe can be confirmed.
Customers should back up important information before submitting devices for repair. Repair timelines may vary depending on the fault, availability of parts and manufacturer requirements.
Any significant additional work or cost outside the agreed repair should be communicated to the customer for approval before proceeding.
7. Special Orders & Product Compatibility
Products specially sourced, imported or customized at a customer’s request may have different cancellation and return conditions, which will be communicated where applicable.
Customers should confirm important specifications and compatibility before purchasing.
Where we recommend a product based on information supplied by you, the recommendation depends on the accuracy and completeness of that information.
8. Online Orders & Cancellations
Customers should review their order details before completing an online purchase and contact us promptly if they need to request a cancellation.
Orders already dispatched, specially sourced or customized may be subject to reasonable cancellation restrictions where permitted by law.
Any cancellation rights provided under applicable Kenyan consumer law remain unaffected.
9. Privacy & Website Use
Personal information is handled according to our Privacy Policy and applicable Kenyan data protection laws.
You must not use our Website for fraudulent or unlawful purposes, interfere with its security, attempt unauthorized access or intentionally provide false information.
Our Website may contain links or integrations with third-party services. Such providers may operate under their own terms and privacy policies.
10. Liability & Events Beyond Our Control
To the extent permitted by law, Onside will not be responsible for losses resulting from product misuse, unauthorized modifications, inaccurate information supplied by a customer, or circumstances outside our reasonable control.
Such circumstances may include courier disruptions, supplier delays, natural events, telecommunications interruptions or government restrictions.
Nothing in these Terms excludes or limits liability or consumer rights where doing so would be prohibited by Kenyan law.
11. Complaints & Dispute Resolution
If you have a concern about an order, product, warranty, repair or service, please contact us with the relevant details so we can investigate and seek an appropriate resolution.
Where a matter cannot be resolved directly, either party may use the dispute-resolution procedures and remedies available under Kenyan law.
Nothing in these Terms prevents a consumer from exercising the right to approach an appropriate regulatory authority or court.
12. Intellectual Property
Our Website content, branding, logo and original materials may not be copied, reproduced or commercially used without authorization.Product names, trademarks and other third-party intellectual property remain the property of their respective owners.
13. Governing Law
These Terms are governed by the laws of the Republic of Kenya.
If any provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
